Reservation Policies and Conditions at NOMAD Hotels

The www.nomad-hotels.com website is published by NOMAD HOTELS, a public limited company registered with the Registre du Commerce et des Sociétés under the number RCS BREST 794 237 909, whose registered office is located at 5 rue Colbert, 29200 BREST and whose intra-community VAT number is FR16794237909.


Preamble

NOMAD HOTELS operates the www.nomad-hotels.com website (hereinafter the "Site"), a hotel reservation site for the brand's 3 hotels: NOMAD Le Havre, NOMAD Roissy and NOMAD Dijon.
The Site allows the reservation of rooms in the hotels of the NOMAD HOTELS brand, of which it is the operator.
The client declares to have obtained all necessary information from NOMAD HOTELS on the Site.
Any reservation via the Site or via the mobile services implies full and unreserved consultation and acceptance of the present General Terms and Conditions of Sale and of the pricing conditions.
The customer's agreement to these General Terms and Conditions of Sale and to the conditions of the fare booked is obtained at the time of booking; no booking is possible without this agreement.
The customer may save and edit these terms and conditions using the standard functions of his browser or computer.

The legal notice allowing precise identification of NOMAD HOTELS and indicating its corporate name, the address at which it is established, its e-mail address, its telephone number, its registered office, its individual SIREN identification number, its intra-community VAT number and the address of the establishment responsible for the offer.

The essential characteristics of the accommodation offered, the prices and the dates of availability of the accommodation are presented on each hotel file in the booking process. Prior to ordering the services, the customer declares that the reservation of these services is made for his/her personal needs. As a consumer, the customer has specific rights, which would be called into question in the event that the reserved services were to be used for purposes that fall within the scope of his or her commercial or liberal activity.

All information accessible on the Site is presented in both French and English. However, only the French language will be binding in the event of a dispute.
The customer declares that he/she has full legal capacity to enter into the present General Terms and Conditions of Sale.

Definitions

In the following, the following terms shall have the following meanings:

" Acknowledgement of receipt ":
E-mail sent by NOMAD Hotels to the customer summarizing the reservation made by the customer and confirming its receipt by www.nomad-hotels.com.

" Reservation confirmation ":
Dematerialized document which summarizes the characteristics of the services booked by the customer via the Website, and by which the customer may enter his/her bank card number in the case of prepayment or a guarantee. Acceptance of the booking confirmation has the effect of contractually binding the customer.

" Customer " :
Natural person acting for personal or professional needs but not related to the hotel business.

" Consumer ":
Any natural person acting for purposes that do not fall within the scope of their commercial or liberal activity.

" E-mail ":
Any message, in the form of text, voice, sound or image, sent via a public communications network, stored on a web server or in the recipient's own equipment, until the recipient accesses the information.

" Reservation request ":
Hotel room reservation request made by the customer via mobile services or the internet.

" Partners ":
Suppliers of services accessible from the www.nomad-hotels.com website, and in particular, tour operators, car rental companies, train or plane ticket suppliers.

" Online Booking ":
Reservation of hotel rooms via the dematerialized reservation voucher on the NOMAD Hotels brand Website accessible at www.nomad-hotels.com.

" Service ":
Reservation of hotel rooms, the essential characteristics of which are presented on the Site www.nomad-hotels.com.

" Mobile Services ":
All services and protocols enabling mobile terminals to be connected to the Internet, and notably enabling the consultation and reservation of hotel services provided by NOMAD HOTELS.

" Website ":
Electronic service operated by NOMAD HOTELS on the Internet network and accessible at www.nomad-hotels.com.


Object and scope of application

The present General Terms and Conditions of Sale define the rights and obligations of the parties within the framework of the remote reservation of services offered by NOMAD HOTELS on its Site.

They govern all necessary steps leading to the reservation and the follow-up of the reservation between the contracting parties.

The client acknowledges having read and accepted the present General Terms and Conditions of Sale and the conditions of sale of the reserved rate accessible on the Website. The present General Conditions also include the Privacy Policy concerning the protection of personal data. By accepting the present General Terms and Conditions, the customer expressly accepts the provisions of this policy.

These General Terms and Conditions of Sale apply to all bookings made on the www.nomad-hotels.com website .


Duration

The present General Terms and Conditions of Sale apply for the entire duration of the online marketing of services by NOMAD HOTELS on the Site. NOMAD HOTELS reserves the right, without prior notice, to temporarily or permanently close access to its Site or the online reservation space.

Reservation

The client selects the services presented on the website.
The customer acknowledges that he/she has taken cognizance of the nature, destination and booking terms of the services available on the Website, and that he/she has requested and obtained the necessary and/or additional information in order to make his/her booking with full knowledge of the facts.
The customer may reserve a maximum of five (5) rooms per reservation on the Site, on an individual basis, and a maximum of five (5) rooms per reservation on the Mobile Services.
For reservations concerning groups, meetings or seminars, an online quote request is available on www.nomad-hotels.com.
The client is solely responsible for his choice of services and their suitability for his needs, and NOMAD HOTELS cannot be held liable in this respect.
The reservation is deemed accepted by the client at the end of the reservation process.

Reservation process

The reservation is deemed to have been made upon receipt of a reservation confirmation by e-mail, or upon online prepayment by credit card. Prior to any reservation, the customer undertakes to fully complete the information requested on the reservation request. The customer attests to the truthfulness and accuracy of the information provided.

The booking procedure includes the following steps:

  1. Hotel selection
  2. Selection of dates of stay
  3. Selection of number of room(s)
  4. Selection of number of occupants per room (Adults and Children)
  5. Selection of room type(s) - for all rooms or for each room
  6. Selection of additional options - for all rooms or for each room
  7. Enter customer details
  8. Verification of booking details, total price, applicable sales conditions and possible adjustments to choice (room, rate, selected option), for online booking only.
  9. Enter credit card number in case of guarantee or prepayment request
  10. Acceptance of price conditions prior to booking validation
  11. Validation of reservation by customer

Booking confirmation

All reservations are automatically confirmed by e-mail, including all booking details.
If you do not receive this confirmation, please contact the hotel directly. We also invite you to consult the "spam" or "junk mail" folder of your inbox.


Cancellation or modification by the customer

Unless otherwise specified in the special conditions of certain rates, reservations may be cancelled or modified by the customer up to 4pm on the day of arrival:

  • Online, by clicking on the appropriate link in the reservation confirmation e-mail,
  • By telephone or e-mail directly to the hotel concerned.


If the customer wishes to shorten their stay, and if the rate initially booked is a cancellable and modifiable rate, the customer must inform reception and vacate their room before 12 noon on the same day. If they fail to do so, they will be charged for the next night, and any additional nights will be cancelled.

All reservations made on the www.nomad-hotels.com website are non-transferable and may not be resold to a third party or via a website.


The hotel will charge the first night's stay to the reserving customer:

  • If they do not take possession of their room on the scheduled day without cancelling before 4pm,
  • If the reservation is cancelled after 4pm,
  • If they leave the hotel on the day of arrival.

Reservations take effect from 3 p.m. on the day of arrival and end at 12 p.m. on the day of departure.
Any complaint concerning a reservation must be made to our Reservations Department or to the hotel within 24 hours of the reservation date.

Guarantee and payment

At the time of booking, the customer provides his or her bank details as a guarantee, except in the case of bookings for restricted rates and any special offers or promotions that are otherwise indicated in the specific conditions of these rates.

Payment for the stay and extras must be made at the hotel during the stay, except in the case of rates subject to special conditions. If payment is made in a currency other than the currency of the customer's country of residence, exchange charges will be borne by the customer.

On arrival at the hotel, a pre-authorization will be made on your card as a guarantee.

Prices

Unless otherwise stated, the prices indicated on this site are in euros, including VAT, per room and per night, for a given number of people per room and for the chosen date.

Unless otherwise stated, additional services (breakfast, half-board, parking, etc.) are not included in the price.
Tourist taxes, which are specific to each city, are not included in the prices displayed, but can be consulted at each hotel or mentioned on the website. They must be paid on site.

Certain promotional offers available on the internet are sold exclusively on the internet, i.e. only by mail order and not at hotel reception.

Tariff conditions

The present conditions complete the General Terms and Conditions of Sale. Please note that the Internet rates on the www.nomad-hotels.com website are non-commissionable.

1. FLEXIBLE RATES: RATES CAN BE CHANGED OR CANCELLED UP TO 4PM ON THE DAY OF ARRIVAL.

Reservations for these rates may be cancelled or modified free of charge by the customer up to 4pm on the scheduled day of arrival. In this case, the modification or cancellation can be made online using the buttons provided for this purpose in the booking confirmation email, or directly with the hotel concerned. These rates and all services consumed on site must be paid to the hotel on departure.

The hotel will invoice the booking customer for the first night of the stay:

  • If they do not take possession of their room on the scheduled day without cancelling before 4 p.m.
  • If the reservation is cancelled after 4 p.m.
  • If they leave the hotel on the day of arrival.

Reservations are confirmed after recording the type of credit card, the customer's credit card number, the card's expiry date (valid on the date of the booking customer's stay) and the name written on the card as a guarantee.

2. RESTRICTED RATES: NON-CANCELLABLE AND NON-CHANGEABLE RATES

Non-cancellable and non-changeable" rates are restricted rates. These rates must be paid at the time of booking. In the case of online bookings on the www.nomad-hotels.com website, payment is totally secure via a PCI-DSS-certified service provider.
If you book a restricted rate by telephone with the hotel, a secure payment link will be sent to you by email. The reservation will be confirmed upon receipt of payment.

These rates are non-changeable, non-exchangeable and non-refundable once the reservation has been confirmed.
Reservations cannot be cancelled or modified for any reason whatsoever. The hotel will invoice the customer for the full cost of the service, even if the room is not used.

Payment

The client provides his/her bank details as a guarantee for the reservation or prepayment in accordance with the conditions of the rate reserved, by credit or debit card (Visa, Mastercard, Carte Bleue, Amex), indicating directly in the area provided for this purpose (entry secured by SSL encryption), the card number, with no spaces between the digits, as well as its date of validity and the visual cryptogram. In the case of prepayment via the Stripe financial platform, NOMAD HOTELS is not liable for its personal data.

Payment is debited at the hotel during the stay, except in the case of special conditions or rates where payment is debited at the time of reservation (online prepayment for certain rates). This prepayment is referred to as a deposit. In the case of non-prepaid online rates, the hotel may ask the customer for a deposit or authorization to debit the credit card upon arrival, in order to guarantee payment of the sums corresponding to the services consumed on site.

In the event of a no-show (reservation not cancelled - customer not present) of a reservation guaranteed by credit card, the hotel will debit the customer, as a flat-rate indemnity, for the amount of the first night on the credit card that was given as a reservation guarantee, and any additional nights of the reservation will be cancelled without charge.

NOMAD HOTELS uses the Stripe payment solution to secure online payments by credit card. The validity of the customer's credit card is verified by Stripe. A payment card may be refused for a number of reasons: stolen card, blocked card, credit limit reached, input error, etc. In the event of a problem, the customer must contact his or her bank and the hotel to confirm the reservation and payment method.

At the time of pre-payment, the amount debited at the time of booking includes: the price of the accommodation, taxes related to the accommodation, the price of the restaurant if breakfast is chosen, taxes related to the restaurant and any additional services selected by the customer.
In the case of online prepayment, the deposit is debited at the time of booking.

Hotel stay

In accordance with current French regulations, the customer may be asked to complete a police form on arrival at the hotel. To do this, the customer will be asked to show proof of identity in order to verify whether or not he/she is required to complete the police form.

For reasons of hygiene, our hotels do not accept pets.

Our hotels are non-smoking establishments. In application of Decree n°2017-633 of April 25, 2017 relating to the conditions of application of the ban on vapoter in certain places for collective use and Decree n°2006-1386 of November 15, 2006 setting the conditions of application of the ban on smoking in places assigned for collective use, smoking and/or vapoter on hotel premises exposes you to a fixed fine of 68€ or legal proceedings to which may be added cleaning costs of up to 400€.

The customer accepts and undertakes to use the room in good manners. Any behavior contrary to good morals and public order will lead the hotelier to ask the customer to leave the establishment without any compensation or refund if payment has already been made. If no payment has yet been made, the client must pay the price of the nights consumed before leaving the establishment, and any damages incurred by NOMAD HOTELS will be charged to the client.

Our hotels offer WIFI access enabling customers to connect to the Internet. The customer undertakes to ensure that the computer resources made available by the hotel will not be used in any way for the purposes of reproduction, representation, provision or communication to the public of works or objects protected by copyright or related rights, such as texts, images, photographs, musical works, audiovisual works, software and video games, without the authorization of the holders of the rights provided for in Books I and II of the Intellectual Property Code, where such authorization is required. Should the customer fail to comply with the aforementioned obligations, he or she risks being accused of counterfeiting (article L.335-3 of the French Intellectual Property Code), punishable by a fine of 300,000 euros and three years' imprisonment. The customer is also required to comply with the security policy of the hotel's Internet service provider, including the rules governing the use of security measures implemented to prevent the unlawful use of IT resources, and to refrain from any action that might undermine the effectiveness of these measures.


Responsibilities

The photographs presented on the Site are not contractual. Although every effort is made to ensure that the photographs, graphics and texts reproduced to illustrate the hotels presented give as accurate an idea as possible of the accommodation services offered, variations may occur, notably due to changes in furnishings or possible renovations.

NOMAD HOTELS may not be held responsible for the non-execution or improper execution of the reservation in the event of force majeure, the fault of a third party, the fault of the customer, in particular the unavailability of the internet network, impossibility of access to the website, external intrusion, computer viruses or in the event of unauthorized prepayment by the bearer's bank.

Hypertext links may lead to sites other than the NOMAD HOTELS site, which declines all responsibility for the content of these sites and the services offered.

Any reservation or payment that is irregular, inoperative, incomplete or fraudulent for a reason attributable to the client will result in the cancellation of the order at the client's expense, without prejudice to any civil or criminal action against the latter.

NOMAD HOTELS cannot be held responsible for any personal effects lost or forgotten during the stay at the hotel.

Respect for privacy

NOMAD HOTELS uses a service provider, Amadeus Travelclick, to manage the online booking process. Within this framework, a confidentiality agreement has been signed between NOMAD HOTELS and Amadeus Travelclick, in order to guarantee the confidentiality of data transmitted during the booking process in accordance with the RGPD.

The information that is requested from the customer at the booking stage is necessary for NOMAD HOTELS to record and confirm the booking.
In accordance with Regulation (EU) 2016/679 on the protection of personal data (RGPD), NOMAD HOTELS is authorized to retain customer data for the purposes of managing customer relations, reservations and customer preferences.

Unless the reserving party objects and following their stay, NOMAD HOTELS may use the reserving party's e-mail address to send them an invitation to complete an online satisfaction questionnaire following their stay.

Nomad Hotels is a brand operated by NOMAD HOTELS, a company in the Oceania Hotels Group. As such, the data collected in connection with your reservation may be used by Nomad Hotels and shared, with your consent, with other entities of the Oceania Hotels Group for commercial prospecting purposes. You may consent to receive offers and communications from the Oceania Group at the time of booking, and withdraw this consent at any time. The Oceania Hotels Group undertakes never to transfer your data to third parties outside the group, and to use it solely for communications in connection with its hotels.

All Account information is used only in the context of the commercial relationship with www.nomad-hotels.com. This information is never shared with third parties or resold. In accordance with the aforementioned European regulations, you have the right to have your data deleted. All requests should be sent by e-mail to dpo@oceaniahotels.com.

Transactions are processed entirely by our partner Stripe's secure payment module.

The customer is informed, on each personal data collection form, of the compulsory or optional nature of the answers by the presence of an asterisk. In the absence of information identified as mandatory, NOMAD HOTELS may not be able to register a reservation and manage any complaints. The information processed is intended for NOMAD HOTELS, its entities, its partners, its service providers (and in particular online payment service providers) and its hotels. NOMAD HOTELS guarantees that these subcontractors comply with current regulations concerning the protection of personal data.

Service providers, entities and hotels may be established outside the European Union. Within the framework of pre-contractual measures for the reservation or execution of the hotel reservation contract, they may, each for what concerns them, be recipients of identity data, personal and professional data, economic and financial information, in particular for the purposes of hotel reservation and complaint management.

The client authorises NOMAD HOTELS to communicate his personal data on condition that this communication is dedicated to the realisation of operations incumbent upon NOMAD HOTELS. Under these General Terms and Conditions of Sale, while respecting current legislation on the protection of personal data.

In particular, during online payment, the customer's bank details must be transmitted by the Stripe payment service provider to the hotel's bank, for the execution of the hotel reservation contract. The customer consents to this transfer, which is necessary for the execution of the reservation. Stripe, in its capacity as a professional, has undertaken to NOMAD HOTELS to take all measures to ensure the security and confidentiality of the data transferred.

The personal data protection policy can be consulted on the NOMAD HOTELS Site in the " Privacy Policy ".

All information in your Account is used solely for the purposes of your commercial relationship with www.nomad-hotels.com. This information is never shared with third parties or resold. With your consent, we place a cookie on your computer. It stores information relating to your browsing on our site (the pages you have visited, the date and time of your visit, etc.). Accommodation

In the event of unavailability of the chosen hotel, or in the event of force majeure, the hotel reserves the right to accommodate the customer in whole or in part in a hotel of an equivalent category for services of the same nature, with any additional cost of the room and transport between the two hotels to be borne by the chosen hotel.

Force majeure

NOMAD HOTELS may not be held liable to the client in the event of non-performance of its obligations resulting from an event of force majeure. Cases of force majeure or fortuitous events are those usually recognized by the jurisprudence of the Cour de Cassations (French Supreme Court).


Applicable law

The present General Terms and Conditions of Sale are governed by French law, without prejudice to any mandatory protective provisions that may be applicable in the consumer's country of residence.


Entire

The present General Terms and Conditions of Sale, the price conditions reserved by the customer, and the booking voucher or request formalize the entirety of the obligations of the parties. No general or specific condition communicated by the customer may be integrated into the present general conditions.
The documents forming the contractual commitments between the parties are, in decreasing order of importance, the reservation order or request (including the specific conditions of the fare booked) and the present general conditions. In the event of any contradiction between the booking form and the general terms and conditions, the provisions of the booking form shall prevail for the obligation in question.

Evolution and modification of the General Terms and Conditions of Sale by Internet

The present General Terms and Conditions of Internet Sales may be modified and/or supplemented by NOMAD HOTELS at any time. In this case, the new version of the General Terms and Conditions of Internet Sales will be published online by NOMAD HOTELS. As soon as the new version of the General Terms and Conditions of Internet Business is published on the internet, it will automatically apply to all clients.
The customer must also consult the additional terms and conditions of sale for each rate, type of room or type of service listed in the rate list.

Complaints and disputes

In the event of a dispute, French law will apply.

The customer is informed of the possibility of resorting to conventional mediation, in particular with the Commission de la médiation de la consommation (Code de Consommation, art. L 534-7) or with existing sectoral mediation bodies, or to any alternative dispute resolution method (conciliation, for example) in the event of a dispute.

With reference to Article L612-1 of the French Consumer Code, a traveler may contact the Oceania Hotels customer service department with any complaint, at the following address: Nomad Hotels Customer Service - 5 rue Colbert, CS 71803, 29218 BREST Cedex, by registered letter accompanied by any supporting documents.
